Rights of Nature, the Southern Resident Orcas, and the Salish Sea

Regulatory based environmental laws are inadequate to sufficiently address the destruction of water and soil, the mass extinction of species, and the climate crisis. This failure is, in part, due to the treatment of nature as property and legal barriers to natural ecosystems defending their rights in court. One approach to addressing these problems is the inclusion of rights of Nature language in legislation and constitutions. Over 12 countries, hundreds of municipalities across the U.S., and several tribal nations have recognized the rights of nature. This presentation will explore significant developments in the Rights of Nature movement, both in the U.S. and internationally, and introduce attendees to a rights-based approach for the critically endangered Southern Resident Orcas. Earth Law Center in partnership with the Legal Rights for the Salish Sea, People for the Ethical Treatment of Animals, and other coalition partners drafted a proposed bill to be introduced in the 2022 Washington Legislature to recognize and protect the inherent rights of the Southern Resident Orcas and the ecosystems upon which they depend.
