I believe that you are one of the legal team for USA Springs, if not could you inform me who is. Thank you.
You probably heard that the town of Nottingham passed the Nottingham Water Rights & Local Self-Government Ordinance during the March 15, 2008 town meeting.
On April 28, 2008 I attended the Board of Selectmen’s meeting to present a work-shop proposal on the Analytic Hierarchy Process.
During the meeting, the Board of Selectmen were asked if they had sent a letter to your client USA Springs, stating that their current business plan was in violation of the Nottingham Water Rights & Local Self-Government Ordinance. They had not.
The last sentence of section 7 of the ordinance states: “If the Selectmen of the Town of Nottingham fail to bring any action to enforce this Ordinance, any resident of the Town has standing in front of the Court for enforcement.”
It seems to me the first step of enforcement is notification to the party in violation of the ordinance that they are in violation. I want to make sure ignorance of the law can not be used as an excuse.
Thus, as a concerned citizen I am making sure that your client’s organization is not ignorant of the existence of this ordinance by sending this registered letter.
