An Ordinance of the Township of Exeter, Berks County, Pennsylvania, Creating an Environmental Advisory Council Providing Operating Procedures and Stating the Powers of the Council
Be it Enacted and Ordained by the Board of Supervisors of the Township of Exeter, Berks County, Pennsylvania and it is hereby enacted and ordained by the authority of the same, as follows:
Article 1. An Advisory Council to be known as the Exeter Township Environmental Advisory Council, is hereby created and shall continue to function until this Ordinance is revoked.
Article II. The Environmental Advisory Council shall be composed of five (5) to seven (7) residents of Exeter Township.
Article III. Council members shall be appointed in accordance with the following:
3.01 All council members shall be appointed by the Exeter Township Board of Supervisors.
3.02 Council members' terms of office shall expire on the first Monday in January following the last year of their term of office.
3.03 Duly appointed council members shall serve a term of three (3) years, except that initial appointments shall be so staggered that the terms of approximately one-third of the membership shall expire each year.
3.04 Whenever possible, one member shall also be a member of the Exeter Township Planning Commission.
Article IV. Council members shall receive no compensation for their services, but may be reimbursed for the expenses actually and necessarily incurred by them in the performance of their duties.
Article V. The EAC is to be advisory to and shall coordinate its activities with the Board of Supervisors, Planning Commission, Historical Commission and any other such Township agencies.
Article VI. The appointed council members shall designate the Chairman of the council.
Article VII. The Environmental Advisory Council shall have the following powers:
7.01 Identify environmental problems.
7.02 Recommend plans and programs to the appropriate agencies for the promotion and conservation of the national resources and for the protection and improvement of the quality of the environment within Exeter Township.
7.03 Make recommendations as to the possible use of open land areas of Exeter Township.
7.04 Promote a community environmental program.
7.05 Develop and maintain an index of all open areas, publicly or privately owned, including, but not limited to, flood prone areas, swamps and other unique natural areas.
7.06 Advise the appropriate Township agencies in the acquisition of property, both real and personal.
7.07 To undertake such environmentally-related tasks as requested by the Board of Supervisors.
Article VIII. The Environmental Advisory Council shall keep records of its meetings and activities and shall submit an annual report to the Board of Supervisors. Minutes of each meeting shall also be forwarded to the Board of Supervisors.
Article IX. The Exeter Township Board of Supervisors may, from time to time, appropriate funds for the expenses incurred by the council.
Article X. Severance Clause
Should any section, paragraph, clause, or phrase of this Ordinance be declared unconstitutional or invalid by a court of competent jurisdiction, the remainder of said Ordinance shall not be affected thereby, and shall remain in full force and effect.
Article XI. Repealer Clause
All Ordinances or parts of Ordinances or Resolutions conflicting with the provisions of this Ordinance are hereby repealed to the extent of such conflict.
